Welcome to ShePrive. This policy applies to all orders placed through our website. By completing a purchase with ShePrive, you (the customer/buyer) expressly and legally agree to all the terms and conditions outlined below. Please read this document carefully.

1. Final Sale Policy (No Returns or Exchanges)

Due to the intimate and highly personal nature of our products (underwear, lingerie, and sleepwear), and in strict compliance with federal and international Health and Hygiene Regulations, ShePrive enforces a strict policy that All Sales are Final.

  • No Returns: Once an order has been shipped and leaves our facilities, the customer is not entitled to return the product or request a refund, regardless of whether the packaging has been opened or remains sealed.
  • No Exchanges: We cannot exchange sizes or colors after an order has been shipped. It is the customer’s sole responsibility to carefully review our “Size Guide” prior to completing an order.
  • Hygiene Guarantee: This strict policy ensures that every ShePrive customer receives a brand-new, unworn, and untampered-with garment, maintaining the highest standards of public health and hygiene.

2. Order Cancellation and Modification

  • Orders are processed rapidly at our fulfillment centers in Poland to ensure swift delivery.
  • Customers may request an order cancellation or modification (such as a size change or shipping address update) within a maximum of [e.g., 2 hours] from the moment the payment is confirmed, by contacting us immediately at [Email Address].
  • Once an order transitions to “Processing” or “Shipped” status, it becomes legally and technically impossible to cancel or modify the order, and the Final Sale Policy will strictly apply.

3. Defective or Damaged Products Exception

All ShePrive products undergo rigorous quality control inspections prior to packaging. However, the sole exception to our Final Sale Policy is if a customer receives a product with a clear manufacturing defect or receives an incorrect item.

In such rare instances, the following procedures apply:

  1. You must notify us via email within a maximum of 48 hours from the date the shipment is marked as “Delivered” by the carrier.
  2. Your email must include the order number, a precise description of the issue, and clear, high-resolution photographs demonstrating the defect or incorrect item, along with photos showing the original tags still attached to the garment.
  3. If a manufacturing defect or an error on the part of ShePrive is verified, we will provide an appropriate resolution (issuing a free replacement or store credit), without requiring you to return the defective item, thereby maintaining our health and safety protocols.

4. International Shipping and Delivery

All ShePrive products are shipped directly from our logistics facilities in Poland (European Union) to the United States of America.

  • Processing Times: Order processing and preparation at our warehouse typically take [e.g., 1 to 3] business days.
  • Shipping Times: Delivery times vary based on the shipping method selected at checkout. The timeframes provided are estimates and not absolute guarantees, as shipments are subject to customs clearance speeds and carrier conditions.
  • Risk of Loss: Once the package is handed over to the shipping carrier, the Risk of Loss and ownership of the items transfer to the customer. We are not legally liable for packages lost or stolen after they are scanned as “Delivered” in the carrier’s tracking system.

5. Customs, Duties, and Taxes (Importer of Record)

When purchasing from ShePrive for delivery to the United States, the customer is considered the “Importer of Record” and must comply with all laws and regulations of U.S. Customs and Border Protection (CBP).

  • U.S. Customs Exemption (Section 321 – De Minimis): Our shipments currently benefit from Section 321 of U.S. Customs law, which allows shipments with an aggregate retail value of less than $800 USD per day to enter duty-free and tax-free. At ShePrive, we structure our shipments to comply with this exemption whenever possible to minimize costs for our customers.
  • Delivered At Place (DAP): All orders are sold under DAP terms (duties unpaid). This means that in the rare event that U.S. Customs decides to inspect a shipment or impose any import duties, state taxes, or handling fees, ShePrive bears no legal or financial responsibility for these charges.
  • Any additional costs for customs clearance are the sole responsibility of the customer.

6. Refused and Undeliverable Packages

If the shipping carrier is unable to deliver the package due to any of the following reasons:

  • The customer provided an incorrect or incomplete shipping address.
  • The customer refuses to accept the delivery.
  • The customer refuses to pay any outstanding customs duties (if applicable).
  • The customer is unavailable to receive the package after multiple delivery attempts.

The package may be disposed of by the carrier or returned internationally. In all such cases, ShePrive will NOT issue any refunds. We cannot reclaim or resell returned intimate apparel, and the customer will bear the full financial loss of the order.

7. Fraud Prevention and Chargeback Policy

By reading and agreeing to this policy at checkout, the customer explicitly acknowledges our strict “No Return” policy.

  • Any attempt to initiate a financial dispute (Chargeback) through the issuing bank or payment gateway under the pretense of “returns not accepted” or “buyer’s remorse” will be legally classified as Friendly Fraud.
  • ShePrive retains the absolute right to submit this legally binding document, the customer’s checkout consent log, and delivery tracking details as conclusive evidence to the bank to successfully contest the dispute and recover the order funds.
