Welcome to ShePrive (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of sheprive.com (the “Site”) and the purchase of any products offered on this Site.

By visiting our Site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms, including those additional policies referenced herein (such as our Privacy Policy and Shipping & Return Policy). If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

2. General Conditions and User Requirements

• By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence (typically 18 years old in the US).
• You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction.
• We reserve the right to refuse service to anyone for any reason at any time.

3. Product Information and Pricing

• European Sizing: We specialize in premium European intimates. Sizing may differ from standard US sizes. You agree that it is your responsibility to consult our Size Guide prior to purchasing.
• Accuracy of Colors: We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor’s display of any color will be accurate.
• Pricing: Prices for our products are subject to change without notice. All prices are listed in US Dollars (USD).

4. Strict Final Sale and No-Return Policy

Due to the intimate nature of the products we sell (lingerie, underwear, and sleepwear), and in strict compliance with global health, safety, and hygiene regulations, ShePrive strictly enforces a Final Sale Policy.

• By placing an order on our Site, you explicitly acknowledge and agree that all sales are final.
• We do not accept returns, exchanges, or issue refunds for any items once they have been processed and shipped, regardless of whether the packaging is unopened.
• The only exception is if you receive a defective or incorrect item, which must be reported within 48 hours of delivery, as outlined in our Shipping & Return Policy.

5. Shipping, Customs, and Import Duties

Our products are shipped directly from our logistics facilities in Poland (European Union) to you in the United States.

• Importer of Record: By ordering from ShePrive, you acknowledge that you are the Importer of Record for U.S. Customs purposes.
• De Minimis Exemption: We structure our shipments to qualify for the Section 321 De Minimis exemption (orders under $800 USD) to avoid US customs duties whenever possible.
• DAP Terms: All orders are shipped Delivered At Place (DAP). Should U.S. Customs and Border Protection (CBP) impose any unforeseen inspections, duties, taxes, or handling fees, the customer is 100% financially responsible for these charges. ShePrive will not issue refunds for packages abandoned or refused due to unpaid customs fees.

6. Payment and Anti-Fraud (Chargeback) Agreement

• You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
• Chargeback Clause: By completing your purchase, you agree to our Final Sale / No Return policy. Any attempt to bypass this policy by filing a chargeback or payment dispute with your bank or credit card company for reasons such as “buyer’s remorse,” “sizing issues,” or “returns not accepted” constitutes Friendly Fraud and a direct breach of these Terms.
• ShePrive reserves the right to dispute such claims using your checkout consent logs, IP address, and delivery confirmation, and may permanently ban you from future purchases.

7. Intellectual Property

All content included on this Site, such as text, graphics, logos, button icons, images, and audio clips, is the property of ShePrive or its content/product suppliers and is protected by international copyright laws. You may not reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission by us.

8. Limitation of Liability

In no case shall ShePrive, our directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, arising from your use of any of the service or any products procured using the service.

9. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Kingdom (England and Wales), without regard to its conflict of law provisions. Any legal actions or proceedings arising out of or relating to these Terms shall be brought exclusively in the courts located in the United Kingdom.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website.
